D-DAY DEFEAT FOR WORKERS' WAGES / 6-6-2013Gov. Veto El Obtúse has vetoed Assembly Bill 218. Feeling invaded? Prepare for more as he challenges the record of his predecessor, Jim the Dim, for vetoing anything and everything that might help the little guy.

5-31-2013 — Nevada Gov. Veto El Obtúse's first veto of the 2013 legislative session came on a bill that would have expanded the rights of injured and oppressed workers victimized by illegal employment practices. What did we expect from this guy?

SB180 was a Democrat-backed measure that would have required courts to award damages, lost wages, benefits, costs and attorney's fees to workers who prevail in employment discrimination suits. Existing law caps damages to two years of lost wages and actual damages. In his veto message, the Republican governor said the bill goes too far by exposing employers to a wide range of damages and fees. Gov. Sandoval vetoed 28 bills from the session two years ago.

The House Ethics Committee has found that Rep. Shelley Berkley “violated House Rules and other laws, rules and standards of conduct” in a mixed decision that also cleared her of wrongdoing on her advocacy to protect UMC's kidney transplant center from closure. The committee found Berkley guilty of “improperly using her official position for beneficial interest by permitting her office to take official action specifically on behalf of her husband’s practice” when she helped him with trouble he had collecting claims through Medicaid, Medicare and the Veteran's Administration.

Update: Single-vote loser seeks recount / Las Vegas Sun 7-19-2011

In the 1980 Republican primary for the southwest Reno Assembly District 25 seat, Patty Cafferata defeated Bob Kerns by one vote. (Sue Wagner, the incumbent, had vacated to run for state senate.)

Kerns did not ask for a recount but took the matter immediately to court, citing the short time frame between the Sept. 9 primary and Nov. 4 general.

The case was assigned to Washoe Dist. Judge John Barrett.

Kerns brought forward a woman, a registered Democrat, who was given a Republican ballot by mistake. She testified that she had voted for Mrs. Cafferata.

Judge Barrett would not throw out the election, adding that he hoped whoever won the seat would address the gap in state election law where such an issue was concerned.

I don't know that it was and, given the confusion over the recent North Las Vegas city council election, it has not.

Barrett's point was that no matter how she testified how she voted, there was no way to corroborate that assertion and he could thus not vacate the result or wipe out one vote for Cafferata and call it a tie.

Cafferata went on to win the general election in the heavily Republican district. Kerns won the seat in 1982 when Cafferata ran for state treasurer.

If the law has not been changed since the Kerns-Cafferata mess, then the Barrett decision, while not having been appealed and thus not a precedent, may provide some guidance in the current debate.

The American electorate is a dumb cow that follows the herd, is easily stampeded, gets milked for all she's worth and produces offspring for meat, muscle or cannon fodder to benefit the few. At a recent meeting of the Reno-Sparks NAACP, the membership voted to write to Nevada newspapers regarding the media-fueled controversy generated by remarks which Sen. Joseph Biden, D-Del, made about Sen. Barack Obama, D-Ill.

Sen. Biden’s complimentary statements were somehow twisted into some sort of a "read between the lines" criticism. We view all of this as distracting, unfortunate and uncalled for.

No fair reading of Sen. Biden’s statement can be interpreted as degrading Sen. Obama.

The candidates for president have work too important to get sidetracked by word games.

Sen. Obama himself said "I’m not going to parse his words that carefully."

War and peace and prosperity affect people’s daily lives. Policies matter.

The pundits and the press would serve us best by focusing on the legitimate national debate.
